How
is constitutional law different from other forms of law, such as
statutory law, common law, treaties, or administrative regulations?
1. It is made in a
different way: Either by the framers in Convention in 1787,
ratified by the state legislatures, or proposed by Congress and
ratified by state legislatures.
2. It is harder to change than
other forms of law, requiring super-majorities in both houses of
Congress (2/3) and ratification by 3/4 of the states.
3. In general, it deals with
more fundamental questions than most other forms of law--the
setting up of government, the distribution of power within government,
and the guarantee of basic rights.
